2. Applicability
These Terms and Conditions apply to all products and services offered via thecityescape.nl, including the purchase and use of digital city tours and their activation in our mobile app.
By using our website or app, or by purchasing a tour, the user agrees to these terms.

3. Offer and Product Description
The City Escape sells digital city tours.
After purchase, the customer receives a unique activation code via email, which can be used to unlock the tour in our free mobile app.
Each tour contains interactive elements such as assignments, route information, and narrative content. The exact content may vary per tour.

4. Delivery, access, and validity period

• Delivery takes place digitally via the email address provided by the customer at checkout.
• The activation code provides one-time access to the relevant tour within the app.
• The activation code must be activated within twelve (12) months of the date of purchase. A code that is not activated within this period expires without the right to a refund or replacement.
• Upon activation, the code is consumed and delivery is complete. The tour is then available on the device on which it was activated.
• The final activation date is stated in the confirmation email.
• It is the customer’s responsibility to provide a correct email address.
• If the email does not arrive, the customer can contact [email protected] for resending.

4a. Group requests and corporate assignments

• For group requests and corporate bookings, the same activation period of twelve (12) months from the invoice date applies, unless otherwise agreed in writing.
• All codes provided to the group must be activated within this period.

5. Prices and payments
All prices on our website are exempt from VAT, as The City Escape participates in the Small Business Scheme (KOR). Therefore, no VAT is calculated or stated on the invoice. Payments are handled via the payment methods offered on the website. The customer receives a confirmation of the purchase via email.

6. Right of withdrawal (digital products)
Our products are digital downloads in the form of activation codes. According to European legislation, the right of withdrawal expires as soon as:
the customer explicitly consents to immediate delivery during the purchase, and acknowledges that the right of withdrawal expires after delivery of the activation code. Because our tours are delivered via email immediately after payment, refunds are not possible after the code has been sent, unless otherwise agreed.

7. Use of the app and activation codes
Activation codes are personal and intended for private use. The City Escape reserves the right to block abuse, fraud, or unauthorized use. The app and all content are the property of The City Escape and protected by copyright.

8. Liability
The City Escape strives for correct and up-to-date information within tours, but cannot completely exclude errors or inaccuracies. Participation in the tour is at your own risk. The user is personally responsible for safety while following routes (e.g., traffic, surroundings, weather conditions). The City Escape is not liable for direct or indirect damage resulting from the use of the website, app, or tours.

9. Technical Requirements
A smartphone with an internet connection is required to use the app. We cannot guarantee that the app will function correctly on all devices.

10. Intellectual Property
All texts, images, audio, routes, puzzles, and other content within our tours and app fall under the intellectual property of The City Escape. Users may not copy, publish, or redistribute this content without permission.

11. Privacy
We process personal data according to our Privacy Policy, available at:

12. Changes to the Terms
The City Escape may change these terms. The most recent version is always available on the website. In the event of substantial changes, we will inform our users if necessary.

13. Applicable Law
Dutch law applies to these terms.
Any disputes will be submitted to the competent court in the Netherlands.
